Tips For Avoiding A DUI Conviction

by Kenneth Pierce

Being charged with driving under the influence, commonly referred to as a DUI, can be a scary experience. However, with the right help, you don't have to let that charge turn into a conviction.

Start by choosing a qualified attorney to represent you, one who is familiar with DUI cases and has won them in the past. From there, follow these helpful tips to reduce your chances of a conviction.

Fight Against Evidence

One of the most important things you can do to beat a DUI is to challenge any and all evidence against you. When possible, avoid providing potential evidence. Steps like refusing to take a breathalyzer test, for example, can make it hard to prove a case against you.

If it's too late for that, then your only choice is to challenge the results of the evidence. You and your lawyer, for example, could work together to find a reason why the test results might not be accurate and to get them thrown out of court. Proving a DUI without adequate evidence is next to impossible, so if you can negate the validity of the evidence, you have a good chance.

Prove an Illegal Stop

Even when someone is driving under the influence, they still have to be stopped for a legal, valid reason. This might include something like not observing a traffic light or having a burned-out headlight.

If the officer did not correctly notate the reason you were pulled over, or if there is inadequate proof of why you were pulled over, your lawyer may be able to get the case thrown out due to the traffic stop not being valid.

This is a line of reasoning that's definitely worth trying with your attorney, especially if you believe and/or have evidence that you were stopped illegally.

Fight Field Sobriety Tests

In addition to going after the results of a breathalyzer, you can also attack the results of a field sobriety test as not valid. Many factors, like being overweight, having on the wrong shoes, or even just being clumsy can cause these tests to be failed, regardless of whether or not the person was under the influence of alcohol. Provide good reasons for why your test was not accurate, and you might just win your case.

In all of these ways, it is possible to challenge a DUI conviction. Don't take one lying down. With the right DUI attorney on your side and these defenses, you really can't go wrong.

About Me

Get Ahead in Your Personal Injury Case

As the sister of a law student, I thought that I could handle my own personal injury case when I was hit by a vehicle as I was walking across the street. Luckily, the car wasn't going very fast – but I did end up with a contusion and a broken leg. Turns out the process wasn't easy and I ended up hiring a lawyer. I learned a lot about the kind of information needed to win a personal injury case such as the kind of evidence that is effective and the types of documentation needed from the insurance company, employers, and even witnesses that were at the scene. My name is Rebecca, and I created this website to help guide you through your personal injury case. There is no reason for you to feel alone throughout the process, and I hope my insight helps you feel more empowered with your decision making.
